New York is the financial capital of the world, and the most expensive state to form an LLC in. A $200 filing fee plus a publication requirement that runs $1,500–$2,000 in NYC. You can form here — but if you don't specifically need New York, a ready-made Wyoming LLC that already has its EIN lets you trade today, privately, with no state income tax.
New York is home to Wall Street, a massive consumer market, and some of the highest business costs in the country. Forming an LLC here costs more than almost any other state, primarily because of a requirement that exists nowhere else: the publication requirement.
After forming your New York LLC, you must publish a notice of formation in two designated newspapers for six consecutive weeks. In New York City, this costs $1,500–$2,000 or more. In cheaper upstate counties, it can be as low as $300–$500. This is on top of the $200 filing fee, making New York one of the most expensive states for LLC formation.
A New York LLC makes sense if you operate in New York, need a New York address for business credibility, or are required to register there due to physical presence or employees. For everyone else — particularly non-residents and founders who just need to trade — we strongly recommend a ready-made Wyoming LLC or, where outside investors are involved, Delaware.
Same goal — a working US company. Very different cost, speed and privacy.

New York Section 206 of the LLC Law requires every new LLC to publish a copy of its Articles of Organization (or a notice of formation) in two newspapers designated by the county clerk in the county where the LLC's office is located. The notice must run once a week for six consecutive weeks.
How it works:
Cost by county (approximate):
Search for available names on the New York Entity Search. Your name must include "Limited Liability Company," "LLC," or "L.L.C." Name reservation costs $20 for 60 days.
New York LLCs must designate the Secretary of State as the agent for service of process. You then provide a mailing address where the Secretary of State will forward any legal documents received.
File online or by mail with the NY Department of State. The filing requires:
Within 120 days of formation, publish in two designated newspapers for six consecutive weeks, then file the Certificate of Publication ($50).
New York requires LLCs to adopt a written Operating Agreement within 90 days of filing the Articles of Organization. This is a legal requirement under NY LLC Law Section 417.
Standard EIN application process. New York LLCs are universally accepted by US banks. (With a ready-made Wyoming LLC, this step is already done — the EIN exists before you buy.)
