The publication requirement, explained

New York Section 206 of the LLC Law requires every new LLC to publish a copy of its Articles of Organization (or a notice of formation) in two newspapers designated by the county clerk in the county where the LLC's office is located. The notice must run once a week for six consecutive weeks.

How it works:

  1. Form your LLC with the Department of State.
  2. Within 120 days, visit the county clerk's office (or contact them) to get the names of two designated newspapers.
  3. Arrange publication in both newspapers for six consecutive weeks.
  4. Obtain affidavits of publication from each newspaper.

How to form a New York LLC

Step 1: Choose your LLC name

Search for available names on the New York Entity Search. Your name must include "Limited Liability Company," "LLC," or "L.L.C." Name reservation costs $20 for 60 days.

Step 2: Designate an agent for service of process

New York LLCs must designate the Secretary of State as the agent for service of process. You then provide a mailing address where the Secretary of State will forward any legal documents received.

Step 3: File Articles of Organization
